1. Agreement

You the consignee, and we, Clearwater Creek Outfitters dba GreenTouch, The Log Furniture Store hereafter (us/we) agree that your order is an offer to purchase the products listed in your order on the terms and conditions listed below which will become a contract when accepted by us via confirmation that specifically references your order or when we ship to you the Products you ordered, whichever occurs earlier, and the banking, negotiation or other use of any payment shall not constitute an acceptance by us. When you send your order to purchase Products to us that order shall constitute your agreement to these Special Circumstances, terms and conditions of purchase. You represent you have the legal authority to enter into this Agreement on behalf of yourself or any party you represent.
This Agreement may not be altered, supplemented, or amended by the use of any other document(s). Any such attempt will be null and void unless otherwise agreed to in a written agreement signed by both you and us. If any provision of this Agreement is held to be invalid by any law, rule, order or regulation of any government or by the final determination of any state or federal court, such invalidity shall not affect the enforceability of any other provision of this Agreement.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, Clearwater Creek Outfitters, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Clearwater Creek Outfitters, LLC WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL PUNITIVE AND CONSEQUENTIAL DAMAGES.

4. Order Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. us/we reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verification or information before accepting any order. Website misprints/prices are subject to correction. Your telephone call requesting placement of your order by phone will also be subject to these same terms and conditions. When you place your order, you will be required to check a box to accept our terms. Your order will not be accepted without checking the box. Production/shipping times shown are averages, not exact, you may opt out of our free shipping offer in leau of faster delivery times at your expense. Production times stated are approximate. We are not responsible for manufacturing delays beyond our control. Product demand varies during different seasons of the year, dictating actual production times, Times stated are approximate and can vary. Delivery times vary by your location. We accept cancellations by email and in person.. This provides you and us a verifiable form of cancellation. If you wish to cancel within the first 72 hours, email us using CANCEL ORDER in the message header and we will reply with an acknowledgement. Please, do not leave cancellations on our voice mail. We do not acknowledge cancellations by voicemail or telephone. Cancellations without penalty will be accepted for 72 hours. After 72 hours our standard refund policy will apply. Deposits on furniture and cabinetry are non-refundable after this initial period. Cancellations cannot be accepted once construction has begun.

5. Refund Policy

Special Circumstances exist for many of our products as they are custom made special for you, and as a result custom built furniture and cabinet sales are final. No refunds, remakes, or post shipment changes are available. Box and off the shelf items are subject to 15% restocking fees and any actual shipping we paid for you. Under no circumstances are shipping fees refunded. If an order cannot be delivered due to actions on your part, you agree to pay all shipping costs we incur. In the event you wish to return an eligible item, you, the consignee are responsible for properly repackaging, insuring and returning the item to our dock. Approved returns will have instructions and written authorization emailed to the same email address used when the order is placed.

6. Payment Terms

We accept all major credit cards mentioned on the product ordering screens as the payment options for your purchase, as well as Paypal. Orders under $1500 are charged 100% to the credit card you provide at the time of your order, for custom items and any order over $1500, a 50% non-refundable deposit is owed when you place your order and the balance when it ships.

7. Guarantee

Any defects in material or workmanship will be promptly rectified, provided claims are made and defective parts are return shipped within 10 days of receipt of goods for our timely examination. Other than assisting with shipping damage claims (see Shipping Damage Claims below) and manufacturer warranties, no additional warranties, expressed or implied, are provided by us. All warranty items must be returned to our Eden Prairie warehouse for repair or replacement.

8. Free Shipping Offer

If you choose to enjoy our free shipping offer, there are several conditions.

• We are offering to pay your shipping costs defined as tailgate delivery, curbside by common carrier for items too large to ship UPS or FedEx, Or to your door via UPS or FedEx. Therefore we will use the method or carrier that is most economical for us, yet still provide safe passage. This can mean your order may ship from different locations at different times. If you need delivery notification in the case of Truck Delivery, there is an $8 fee per notification. A delivery liftgate to lower your order to the ground is also an option. With our Free Shipping Offer, we do not provide exact time frames or delivery days, liftgates or in home delivery. Some of these services may be available as an add-on to the delivery, however that would be at additional expense for you. In some circumstances, you may need to arrange with the delivery company to meet at a parking lot nearby to receive your delivery should your specified address not be accessible for a semi-truck. The truck will not come into your driveway.
• We can normally ship and have your order arrive weekdays within a 5 day range at no additional cost.
• All items from the same manufacturer must ship as one unit. If you choose to break-up the shipment in order to receive items sooner, you agree to pay our actual shipping costs for the balance of the order.
• If you choose to return an item for which we paid the shipping, that shipping cost will be deducted from the cost of the item after the restocking fee is deducted.
• YOU MAY OPT OUT OF OUR FREE SHIPPING OFFER AND USE YOUR OWN TRANSPORTATION. We will package your order and have it available at our dock.
• No Credit will be extended to deliveries not completed due to actions on your part.

9. Shipping Damage Claims

PLEASE READ! All items to be shipped are carefully packaged by us or are in the manufacturers original packaging. Orders shipped by truck/18 wheeler are secured to an over-sized pallet and banded to the pallet. The entire order is then stretch-wrapped, labeled and shipped. Occasionally, damage in shipping occurs. On receipt of your order, INSPECT all items for damage, and make note on the delivery receipt. DO NOT REFUSE DELIVERY!! YOU HAVE AGREED TO BE RESPONSIBLE FOR ALL SHIPPING COSTS BOTH DIRECTIONS WHEN PLACING YOUR ORDER! If we selected the shipping method, we will assist with the damage claim and get replacement product to you as soon as possible. We will arrange with an inspection by the carrier, and they will return the damaged item to us at their expense. THE DRIVER IS NOT THE INSPECTOR! All claims for shipping damage must be filed by the recipient with the trucking company/carrier within seven days. Retain ALL original packaging materials including the box or pallet in the event of damage as it will be used by the inspecting agent handling the claim. We may request digital photographs of the damaged product.
